1. INTRODUCTION

By placing orders at ONE clothing (“we,” “us,” or “our”) through our website www.oneclothing.eu, you agree to be bound by the following general Terms and Conditions and our Data Protection Policies. Please read through these Terms, our Cookies Policy, and our Privacy Policy (together the “Data Protection Policies”) before using this website. The applicable language of the Terms and Conditions is English.

If you do not agree to all the Terms and the Data Protection Policies, do not use this website. These Terms and the Data Protection Policies may be amended, and it is your responsibility to regularly read them. By purchasing any product from this website, you enter into a contract with us on these terms.

4. USE OF OUR WEBSITE

By using this website, you undertake:

  • To use the website exclusively for legitimate enquiries or orders.
  • Not to make any speculative, false, or fraudulent orders.
  • To provide correct and accurate contact details.
  • To be at least 18 years old and legally capable of entering into binding contracts.

5. HOW THE CONTRACT IS FORMED

The information and details on this website constitute an invitation to trade. No contract will exist until your order is accepted by us. We will confirm this acceptance through an email (the “Shipping Confirmation”). The Contract will only relate to items confirmed in the Shipping Confirmation.

6. PRODUCT INFORMATION

We aim to be as accurate as possible in our product descriptions. We do not warrant that product descriptions on this website are error-free.

7. AVAILABILITY OF ITEMS

We reserve the right not to deliver if stock levels were incorrect. Refusal of orders may occur in exceptional circumstances.

8. PRICE

Prices are as stipulated on our website, except in cases of obvious error. We retain the right to change prices. VAT is included for [EU, UK, and Switzerland], but not for [Norway or USA].

9. PAYMENT

Payment methods include [Credit/Debit cards, Klarna, iDeal, PayPal]. We use a security standard called 3D-Secure for card payments.

10. DELIVERY TIMES AND SHIPPING RATES

Delivery times and rates vary. Shipping costs are added to every order you place on our website. At the moment we only ship to BELGIUM.

11. RETURN POLICY

You have 30 days to return items, except for damaged items.  If your parcel contains any damaged items, please inform our customer service team (hello@oneclothing.eu) within 48 hours from the date you receive them. You will then have a further 14 days to send them back to us. Shipping costs for returns are not compensated by ONE Clothing.

12. RIGHT OF WITHDRAWAL

You have the right to withdraw from the contract within 14 days.

  1. Based on the law you have a period of 14 days after receiving the product, to withdraw your agreement with ONE Clothing, without giving any reason.
  2. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by sending us an unequivocal statement (e.g. a letter sent by post or e-mail). It is also possible to withdraw the agreement partially. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
  3. The right of withdrawal is not provided for sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
  4. After terminating the agreement please return the product as soon as possible, but no later than 100 days after receipt of all the products in your order, to the address of ONE Clothing as stated in the shipping label which you will receive via email.
  5. You can try out our product(s) as far as necessary to make a purchase, like you would do in an actual shop. Make sure that the cards are still attached and that the original packaging is undamaged when returning. For products that are incomplete, damaged, have been washed, the labels have been removed, or showing other signs of wear ONE Clothing will have to deduct this decrease in value from the total amount to be refunded to you. Only ONE Clothing is entitled to determine the decrease in value.
  6. ONE Clothing will refund the amount paid, exluding shipping costs, within 14 days after receiving the returned product(s). In the case of a partial cancellation, we only refund the costs of the returned product. We will refund you with the same payment method that you used to make the original payment.
  7. The shipping costs to return the product(s) are not compensated by ONE Clothing.

13. LIABILITY AND DISCLAIMERS

We are not liable for business losses. Items are supplied for domestic use. We disclaim all other warranties. Natural characteristics of materials used are expected.

14. FORCE MAJEURE

We are not liable for failure to perform due to events outside our control.

15. INTELLECTUAL PROPERTY

All copyright and trademarks remain vested in us or our licensors. Material may only be used as authorized by us or our licensors.

16. VIRUSES, HACKING, AND OTHER CYBER CRIMES

You may not misuse this website. We accept no liability for loss or damage resulting from cyber-attacks.

17. LINKS FROM OUR WEBSITE

We have links to third-party websites for information purposes. We accept no liability for any loss or damage from using such links.

18. WRITTEN COMMUNICATIONS

Communication with us will be mainly electronic. You agree to electronic communication for all contracts, notices, information, and other communications.

19. OUR RIGHT TO VARY THESE TERMS

We have the right to revise and amend these Terms. Changes will apply to orders placed after the amendment.

20. LAW AND JURISDICTION

The use of our website and Contracts will be governed by Belgian Law. Disputes will be subject to the non-exclusive jurisdiction of Belgian courts. This does not affect your statutory rights.
